How are they able to make Bastion Booger? Doesn’t WWE own the gimmick?

It’s officially licensed through Mike’s estate. As far as I know, WWE does not own the rights to generic, non-branded ring attire, so there shouldn’t be a hold up over his usage.

Could the same potentially apply to Matt Bourne, as he often used the "clown" gimmick elsewhere after being fired by Nonce McMahon.

Not sure whether to buy this figure; it looks great, no doubt - but he’s not I character I really care about enough to drop £60 on.
The only real pull is him being part of the orange card set, but then I could always make one like the Hasbro would’ve been (earthquake body).
But I passed on the Jarrett and now kind of want one, even though I don’t particularly like how it looks.

He got a c&d for this when he was in ECW. Even the Reborne character was critical.

WWE's trademarks for most 90's wrestlers have expired. Many of the wrestlers, especially those who were still active on the indys, trademarked the names themselves. Not sure if that applies in this specific case, but in general WWE no longer owns most of those trademarks.
