Have we confirmed it was from a company PC? I got the impression that it was from a home computer, being in "his area". Otherwise, wouldn't everyone on the shift be a suspect? Yeah, that's the same thing I was thinking. I used my credit card to buy that info.

Invasion of privacy has no bearing on this issue.. It was at a work computer. For those saying "how do we know it was a company computer", well, how else would the boss do an IP trace and see all the names you've logged in as? It's not like he snuck into the guy's house or something.
Freedom of speech issue is a bit iffy. I don't know how it works when you are using somebody else's property to get your message across. If your dad this at your home computer, and as long as he didn't commit libel against any particular person, then he has every right to trash the company. But by doing it on the company's computer, I think an argument can be made that he had no right to use the hospital's computer to trash the hospital's reputation.
Regardless, YOU undoubtedly have legal withstanding for getting your job back, although if I were you I certainly wouldn't ever want to work there again.

If it's your home computer and your trashing your company, they may not be able to fire you specifically for that (unless they claim you're revealing confidential company information), but they can probably make it difficult for you at work to the point that you screw up and they can fire you. I think he should contact the union rep and he probably has a good case to get re-hired. The question is: do you want to work for a company that obviously doesn't want you there?

Well, I have an appointment with my lawyer monday to talk about wrongful termination. He also said from his understanding if he heard me correctly that it can also be illegal interogation since I didn't get to chose who I wanted as Union representation and because they were trying to force me to answer questions with answers I didn't have. I'll update monday. Also my dad was in the wrong and I agree with him getting in trouble, evne though it was a very harsh way to get the message across, and yes this was a company computer.

Well, I should point out it may be more trouble than it's worth to get the job back. After all the legal bills and hassles you can be sure they won't make it easy for you. I've seen people at my work get fired, sue and get their jobs back and quit not long after because admin just made it too miserable for them to work there.

Once the lawyer hears his story, he probably won't even try to get the job back. He'll probably go straight for a settlement, by showing the company how in the wrong they were, and how big of a wrongful termination lawsuit he can bring to them. Most times, a company will just settle to avoid a lengthy and costly lawsuit. The fact is, most people don't go to the trouble to file a lawsuit though.

What happened to freedom of speech? It seems like every time someone in this country says something someone doesn't like or gets offended by, someone's out of a job or screwed by the courts. Why say we have freedom of speech when in reality, we really don't? Look at this dude for example, he was just stating his oppinion. Same with Don Imus & Dog the bounty hunter....what's up with them? Jesse Jackson has to start a crusade on them and get them kicked off the air. If Oprah said something defaming a white person, no one would bat a lash. This country is getting worse instead of better it seems.
I hope everything works out for the best dude.

It doesn't include other reprisals. If you trash your employer, your employer can fire you. If you slander someone, they can still sue you. People take freedom of speech to mean that they can say anything at all about anyone at all and face no repercussions whatsoever.

Actually, this is a rare case, because he was under a specific contract to not do exactly what he did. Of course you can get sued for slander and libel, but those laws are intact to prevent damaging lies. If you could prove either of those things to be done in a comedic manner, you can't get into trouble for them, because comedy is protected. Otherwise, about 95% of the time, you can say whatever you like without any repercussion.
