Oh,man,i dont know..it's pretty disappointing. Also wouldn't be surprised if they were to get a c&d from Mattel. The sculpt looks like they scanned in all of the parts to an elite figure and tweaked them a bit in zbrush.

Oh,man,i dont know..it's pretty disappointing. Also wouldn't be surprised if they were to get a c&d from Mattel. The sculpt looks like they scanned in all of the parts to an elite figure and tweaked them a bit in zbrush. i'm no lawyer by any means, but i feel like even the littlest tweaking would be enough to set it apart enough for them to not get a cease and desist. especially in this era when there's enough action figure brands with similar styles of articulation. but that being said, i would also not be at all surprised if mattel's lawyers tell them they need to change it up a little more

Scummy move, yeah. But, thats why you make sure to get some form of compensation upfront (wether its half or all). Dont know why so many freelancers willingly give people the opportunity to screw them over. If you remove that opportunity, you tend not to get screwed over.

I've got two on pre-order, ones for a mate. I can't believe I've legit bought a Mattel Elite, I don't know what I was really expecting, but it's no different.
Davey Boy Elite with a Dynamite head.
I agree with what's been said though, once Mattel see this surely they have every right to say this is an exact copy of their work. I wouldn't blame them. If I seen this without the packaging, it IS a Mattel Elite all day long.

It almost depends upon if it’s worth their while to even do a cease and desist letter if they were to think that way How much business will chella be taking away from mattel? Can’t think they’d do talent open to mattel in this form, the backlash against the chella name will linger (even if and once the company name changes - arguably unfair to the new owners but that’s the way these things go), might not even be worth Mattel’s time to think about it tbh

I think it looks pretty good, the only thing is the weird flexing wrinkles on the chest. It was probably done to differentiate from Mattel's torso. The head also reminds me a bit of Mattel's Tully Blanchard. BTW, are these figures going to follow height scale?

Mattel did try to sue Remco in the 80s over that muscular MOTU buck and lost. In that instance, even though the style was similar and Remco even admitted they were inspired by the Motu buck-at the end of the day- they were still different sculpts so Remco won.
This doesnt seem like an instance of "being inspired by" as much as it is someone blatantly using Mattel assets as a starting point to create a similar product. But, ultimately, this isnt being sold all over the place alongside Mattel products like Remcos were back in the day so doubt they are going to do anything about it.

I’m by no means an expert but I do find copyright snd trademark law interesting
I would think on something like a body of an action figure you can’t get a patent for it but could get a design patent / registration for it.
The difference being a design patent is just that, for the design, so only a very small change is required to get past that

You have to take into account how an action figure is engineered. The parts used internally and externally to make it move and function. While there is a huge market of six inch toys, how many figure lines can you think of that look exactly the same in design and aesthetics? Marvel Legends, Jazwares AEW etc. Every new line creates a unique sculpt and design to avoid this.
Imagine it like designing a car. If I bought a Tesla and reverse engineered it for small time manufacturing, but tweaked a few minor details. Would that be okay to produce?
