I bought a DK published book (2015) of WWE ultimate superstar guide recently. It consists of 200+ wrestlers, managers, divas & ring announcers, etc., each with a profile page. What caught my attention was that some big name legends were missing in there but not other midcard legends, and the book would go so far as to introduce announcers & referees as fillers instead.
Those missing popular legends include: Chris Benoit Owen Hart Bill Goldberg Sid Kurt Angle Ken Shamrock Jeff Jarrett The Patriot Ahmed Johnson Scott Steiner Rick Steiner Raven Adam Bomb Jim Neidhart etc.
Coincidently, all these legends were never made into Mattel figures to date.
Next, I look at some legends who exist in the book and who were also given the Mattel treatment: * marks those that were recently sold or announced by Mattel within past year till now.

This could mean most of those listed in the book are characters that WWE & Mattel are allowed to make as toys. While those not mentioned are untouchables.
If this hypothesis holds true, then in the near future the possible legends figs that could materialise could be those legends listed in book who have yet to be Mattel-ized. They are as follows:
Afa (probably wont sell well) Big John Studd Bob backlund Nasty boys Brooklyn brawler Don muraco greg valentine harley race IRS koko b ware rocky johnson Sika viscera

I thought the same thing when I saw that book. I think you are correct. Since those drawings are 'new content' WWE would either have to have a deal with that person or at least pay them a royalty of some kind.
I was disappointed that Lita wasn't in the book. A lot of people were buying it WrestleMania weekend and using it for autographs.

It's very good logic.
and from what we know about the first subset, it makes sense. I think a few of the top list are just down to the fact they are big names and WWE will only want to include them in things, when they can make money from them.
An Anvil figure is likely, considering they have paid for his rehab recently.

That's a great post - it does seem likely that those others can be made into action-figures. Out of that list, I'm most interested in:

Mattel has the licence for AT LEAST another 4 years, so I can definitely see most of them - if not all - being made. Especially as we now have things like the Target HOF series as well.

Nice deductive reasoning!
Sid did get a Jakks figure though. Has he done something lately to get on the WWE bad list?
I desperately want a Neidhart as well so we can get a Hart Foundation. Seems like two of the best tag teams of all time are in holding pattern while team members' issues get worked out. In the interim, maybe Mattel will look at The Midnight Express and Rock-n-Roll Express.

I desperately need any Harley Race they'll make. I'd love an nwa champion Harley with the red and blue robe(basically a re-release of the Jakks version).
But in all likelihood with it being WWE, they'd release a King version first...which would be equally as awesome.

Your post makes good sense and I wouldn't be surprised if you were right on your logic. From the list of potential figures, the only ones that jump out at me as 'must haves' would be the the Nasty Boys and IRS. Everyone else I would still probably buy, but if they were never made I would be ok with it.

Earthquake was made right after having a profile in the true giants.DVD. I would guess other guys with profiles in there would be eligible as well like giant Gonzalez, mable and big john studd. Can't remember everyone else who had a profile there as well

I only care about Anvil. Since we'll never get Owen, he needs to be the final piece for the new Hart Foundation. Bret, Davey Boy, and Pilman are looking lonely.

I don't think you can put too much stock into this book (it looks like a comic book designed for kids) and the wrestlers that are not included. Based on the lists in the OP, the conclusion I reach is that those included in the book are under a legends deal and the ones that aren't in it, do not have any deal with the WWE. I don't think it necessarily means the guys not included are not on good terms with WWE- I thought Sid was on good terms with them?!
As for which legends might get a figure made in the future, I was thinking about this the other day and came up with the following which is based solely on sales potential:
Big John Studd Brutus Beefcake Greg Valentine I.R.S. Koko B. Ware Jim Neidhart Bob Backlund* Don Muraco* Harley Race*
* These are ones which I am not sure of how well they will sell but might still be possible due to the HOF line.
